COURT: 52-3 District Court, Rochester Hills, MI

RESULT: Ms. Hartig’s cross examination of the arresting officer, presentation of defense witnesses, intense preparation and closing argument resulted in a jury verdict of not guilty.

CHARGE: DRUNK DRIVING, 1st Offense

COURT 52-4th District Court, Troy, MI

RESULT: Ms. Hartig filed a legal motion requesting that the case be dismissed because the client was “seized” (pulled over) without probable cause. Case dismissed. Note: The Government has filed an appeal of Judge Bolle’s decision the Oakland County Circuit Court. The is a case of first impression in Michigan.

CHARGE: Drunk Driving, 1st Offense

COURT: 52-3rd District Court - Rochester Hills, MI

RESULT: Client offered and pled to a Reckless Driving, keeping the DUI off his record. Plea bargain only offered by the Government after Ms. Hartig filed a Motion to Suppress/Dismiss.

CHARGE:  Felony Child Endangerment | Drunk Driving, 2nd Offense

COURT:     44TH District Court, Royal Oak, MI 

RESULT:   Ms. Hartig's cross-examination of the police officers convinced the Prosecutor to dismiss the felony charge against the client. The court sentenced the client to probation without any jail time.

CHARGE:  Client charged with Drunk Driving

COURT:     48TH District Court, Bloomfield Hills, MI 

RESULT:   Case dismissed by Judge after Ms. Hartig filed an Entrapment Motion arguing that the Client was forced to drive drunk by a police officer.

CHARGE: Client charged with Drunk Driving

COURT:  46th District Court, Southfield, MI

RESULT:  Case dismissed by Judge because Ms. Hartig filed a Motion to Dismiss arguing that the Client was stopped in violation of the 4th Amendment because client’s constitutional rights were violated because the traffic stop of his car was illegal.

CHARGE: Client charged with Carrying a Concealed Weapon and Drunk Driving.

COURT:  47th District Court, Farmington Hills, MI

RESULT:  Case dismissed by Judge following Preliminary Examination because Ms. Hartig argued the Officer’s testimony was so different from the in-car video, he was incredible and that he lacked the probable cause to stop the car.

CHARGE: Client charged with Possession of Marijuana.

COURT: 35th District Court, Plymouth, MI

RESULT:  Ms. Hartig asked for and was granted a directed verdict of acquittal following the Prosecutor’s case arguing that the case was so weak the Defendant should not be forced to put on any defense evidence.  A directed verdict of acquittal is the equivalent of a not guilty and is granted very rarely.

CHARGE:  Violation of Probation on a Felony Drunk Driving

COURT: 6th Circuit Court, Pontiac, MI

RESULT:  Violation of Probation was dismissed because Ms. Hartig brought a Motion to Dismiss arguing that the Government had waited too long to arrest the Defendant (four years) and had violated his right to a Speedy Arrest and had therefore waived the probation violation.

CHARGE: Criminal Sexual Conduct 1st degree, Distribution of a Controlled Substance to Commit Criminal Sexual Conduct.

COURT:  Berrien County Circuit Court, St. Joseph

RESULT:  Following a three week trial with twenty witnesses and two other alleged victims testifying, client was found not guilty of count two and the jury was unable to reach a verdict on count one.  Prosecutor thereafter offered the Defendant a plea bargain that may have resulted in no jail time.

CHARGE: Drunk Driving 3rd Offense (Felony)

COURT: 52-3 District Court Rochester Hills, MI, 6th Circuit Court Pontiac, MI

RESULT: Following a Motion to Suppress filed by Ms. Hartig, the District Court and Circuit Court suppressed the DataMaster results (breathalyzer) because video evidence showing the Defendant taking the breathalyzer was destroyed by the police.

CHARGE:  Client contacted Ms. Hartig before being charged.  Client accused of stealing a purse and its contents worth over $1000.00, a potential felony charge.

COURT: 43rd District Court-Ferndale, MI

RESULT:  Ms. Hartig convinced the Detective in charge of the case to request a misdemeanor warrant for Larceny under $100.00.  Ms. Hartig was able to convince the City Attorney and the Judge to allow the client to plead to disorderly conduct, which will be dismissed entirely after one year’s time.
